CALIFORNIA CONSUMER PRIVACY POLICY
CALIFORNIA RESIDENTS
ONLY
PLEASE DO NOT CONTINUE IF YOU ARE NOT A CALIFORNIA RESIDENT
This policy supplements our Privacy Policy and applies only to CA residents (“CA Consumers” or “Consumers” or “You”) who access the website, utilize website services, or provide their information to the website via a form submission. These terms are presented in compliance with the California Consumer Privacy Act of 2018 (“CCPA”) and other applicable CA privacy laws. The terms defined in CCPA shall have the same meaning when used in this policy. These terms contain important information regarding the website’s practices for the collection, use, transfer, and sale of Personal Information from CA consumers while providing detailed instructions on how to exercise their statutory rights under CCPA. Only CA residents, or their authorized registered designated agents, can submit CCPA requests pertaining to their Personal Information for verification and processing to the website. The operators of this website reserve the right to modify, replace, and amend these terms at any time and when revisions are implemented, they will take into immediate effect upon publication, replacing and superseding any previous version of the terms. Therefore, you are encouraged to review this policy each time you access the website as your continued use of the website after such changes shall constitute your acceptance.
A. CONSUMER REQUEST TO KNOW HOW PERSONAL INFORMATION IS COLLECTED, DISCLOSED, OR SOLD. Consumers residing in California have the statutory right to request that the operators of this website reveal to them what Personal Information is collected, used, disclosed, and sold that belongs to them. California consumers can submit a CCPA request to be verified by this website and request to obtain the specific Personal Information this website has collected about them by emailing this website directly at the information below. Upon receipt of said CCPA request from a consumer, the website is required by CA statute to verify that the consumer requesting the information is the same individual with whom this website has the information in their database. To verify identity and protect against fraud or data breach, the website will ask the CA consumer to provide certain limited types of information to the website for the sole purpose of verifying the requesting consumer’s identity, which may include, but not limited to: (i) full name; (ii) physical address; (iii) email address; and/or (iv) last four digits of a social security number. This aforementioned requested information shall be limited to the information that the CA consumer initially provided during their submission to be connected to services and no additional information shall be requested by the website to perform such CCPA verification. Once the website verifies a CCPA request, the website will disclose the following to a verified consumer:
(i) The categories of Personal Information we collected about the consumer;
(ii) The categories of Sources for the Personal Information we collected about the
consumer;
(iii) Our Business/Commercial Purpose for collecting or selling the Personal Information;
and
(iv) The categories of third-parties with whom we shared that Personal Information.
As presented in the website’s accessible Privacy Policy, the website collects several types of information about consumers, either individually or in combinations, when consumers access and utilize the website, including but not limited to, Personal Information, demographic information, behavioral information, and indirect information. Personal Information is collected by the website directly and indirectly from a consumer’s use of this website and their interactions or communications, such as submission of a loan request form. In order to provide consumers a free service, the website in return receives monetary compensation for its disclosure (or “passing”) of consumer’s Personal Information with the following: (i) affiliated entities; (ii) lenders, including tribal lenders; (iii) information and data aggregators; (iv) financial institutions; (v) financial service providers; and (vi) advertisers who provide goods and services. Further, the disclosure of Personal Information by the website is made for the following commercial and business purposes: (a) to obtain the financial services or short-term loan products consumers request through the website; (b) to allow third-parties to market related financial products and services to consumers; (c) to resolve consumer inquiries and opt-out requests; (d) to enhance the website and optimize its user experience; (e) to preserve the security of the website and its services for legal and compliance purposes; and (f) to respond to any regulatory or government entity inquiries which we are required by law to respond to. The following types of information are not considered “Personal Information” under CCPA: (i) publicly available information from public and government records; (ii) de-identified consumer information; (iii) information not included in the scope of CCPA; or (iv) personal information covered by certain industry specific privacy laws, including the Fair Credit Reporting Act, the Gramm-Leach-Bliley Act, or California Financial Information Privacy Act.
B. CONSUMER REQUEST TO DELETE PERSONAL INFORMATION. CA consumers have the statutory right under CCPA to request the deletion of their Personal Information from the website and its databases if the website has collected or maintained the consumer’s Personal Information in the previous twelve (12) month period. To request deletion of your Personal Information by the website, contact the website directly at [email protected] with the Subject Line “CCPA Right to Delete,” or include a clear message requesting the website delete your Personal Information. Once the website is able to verify a consumer and process this deletion request, the website will archive the consumer’s personal information in a secure and encrypted, separate database scheduled for destruction in three (3) years from the date they initially provided their information to the website. The Personal Information will no longer be utilized for any purpose, however, the website must store the information as it is precluded from processing deletion immediately by contractual and statutory prohibitions set forth in the Telephone Consumer Protection Act (“TCPA”), The CANSPAM Act of 2003 (“CANSPAM”), and California Business and Professions Code Section 17529.5.
C. CONSUMER REQUEST TO OPT-OUT OF THE SALE OF PERSONAL INFORMATION. CA consumers have the statutory right to opt-out of any sale, passing, or sharing of their Personal Information by a business whom they provided their information to previously. Please note that by initially submitting a loan request on the website, you are essentially requesting that we share your information with lenders and third-parties to connect to a short-term loan or other financial services. Therefore, this would be an exemption from this statutory right. Regardless, if a CA consumer still decides to submit a CCPA request to opt-out of the sale and sharing of their Personal Information, the website will honor any opt-out request and cease all further sharing of information. CA Consumers under CCPA have a statutory right not to receive discriminatory treatment for the exercise of their rights under CCPA and the website does not engage in this type of discrimination. The operators of the website will not deny any consumer services or provide a different quality of service due to the receipt of a CCPA request. However, if a consumer does exercise their statutory right under CCPA to opt-out of the sharing or selling of their information to third-parties, then the website will not be able to properly provide its services because its services mainly involve passing information to third-parties.
D. LIMITATIONS & VERIFICATION. CA consumers are allowed to submit a CCPA request to be verified by the website twice (or “two times”) within a twelve (12) month period. The “verifiable consumer request” must provide the following: (i) sufficient information that allows the website to reasonably verify the identity of the consumer to ensure they are the real individual about whom the website collected Personal Information; (b) describe the CCPA request with sufficient detail to allow the website to properly understand and respond to the California consumer. Specifically, and importantly, whether a California consumer is requesting to know, requesting not to sell, or requesting to delete their information by the website. For security and data privacy reasons, the website does not respond to a consumer CCPA request if the website is unable to verify the request or the identity of the consumer per process presented above. The Personal Information a California consumer provides in the CCPA request to be verified will only be used by the website to verify the requestor’s identity and maintain data security. In addition to the statutory rights provided under CCPA, CA residents may also be able to request a list of third-parties to whom this website has disclosed certain personal information for direct marketing purposes in the preceding calendar year. To make such request, CA consumers should contact the website using the information provided below in these terms.
E. RESPONSE TO REQUESTS. The operators of this website respond, and process verified CCPA consumer requests within the statutory prescribed time of forty-five (45) days after receipt of request. In the event the website requires more time to process a CCPA request, the website will provide the California consumer written notice and further information about the extension. This notice will be provided by electronic mail to the contact information a California consumer provides.
